' NEW YORK — Success Academy, New York City's largest charter network, can move forward with two schools in traditional public school buildings when classes start Monday, a Manhattan Supreme Court judge ruled Friday in a lawsuit seeking to block the move.

Details: Justice Lyle Frank dismissed a lawsuit filed by the United Federation of Teachers, the city’s teachers union, to block the co-location of two Success charters at school buildings in Far Rockaway, Queens and Sheepshead Bay, Brooklyn.

“The Court finds that the legislature has made it clear … the State Commissioner of Education, an independent actor not within the government in which petitioners are aggrieved by, maintains original jurisdiction over claims of alleged failure to comply with the Education Law,” Frank wrote in the decision. '
